By accessing or using Hirely (“the Service”) at https://hirely.0degrees.build, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all users of the Service, including company administrators, recruiters, and job candidates.

2. Description of Service

Hirely is an AI-powered hiring platform that enables companies to create branded careers pages, post job listings, screen candidates using AI, and schedule interviews. Features include but are not limited to:

• Company careers page creation and management
• Job posting and applicant tracking
• AI-assisted candidate evaluation and scoring
• Google Calendar integration for interview scheduling
• Candidate communication via email and WhatsApp

3. Account Registration

To use Hirely, you must:

• Provide accurate, complete, and current information during registration.
• Maintain the security of your password and account credentials.
• Notify us immediately of any unauthorized use of your account.
• Be at least 18 years of age or have legal authority to enter into these Terms on behalf of your organization.

You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to use the Service to:

• Post false, misleading, or fraudulent job listings.
• Discriminate against candidates based on protected characteristics.
• Collect or harvest personal data without proper authorization.
• Attempt to reverse-engineer, hack, or disrupt the platform.
• Upload malicious code, viruses, or harmful content.
• Violate any applicable local, national, or international law or regulation.
• Use the AI features to make fully automated decisions about candidates without human review where required by law.

5. Google Calendar Integration

When you connect your Google account, Hirely may access your Google Calendar to create, update, and delete interview events on your behalf. By granting this permission:

• You authorize us to manage calendar events solely for interview scheduling purposes.
• We will not read, store, or use your calendar data for any purpose beyond scheduling interviews within Hirely.
• You can revoke this access at any time via your Google Account settings.

Our use of Google APIs complies with the Google API Services User Data Policy.

6. Intellectual Property

All content, features, and functionality of the Service — including software, text, graphics, logos, and AI models — are owned by Hirely or its licensors and are protected by intellectual property laws.

You retain ownership of content you upload (job descriptions, company information, etc.) and grant Hirely a limited, non-exclusive license to use such content solely to provide the Service.

7. Candidate Data and Privacy

As a company using Hirely, you are a data controller for candidate personal data collected through the platform. You are responsible for:

• Having a lawful basis for collecting and processing candidate data.
• Informing candidates how their data will be used.
• Complying with applicable data protection laws (GDPR, CCPA, etc.).
• Handling candidate data securely and deleting it when no longer needed.

Our Privacy Policy explains how we collect and process data as a data processor on your behalf.

8. AI Features Disclaimer

Hirely's AI-powered features (candidate scoring, voice analysis, matching) are provided as decision-support tools only. They are designed to assist human recruiters, not replace human judgment.

• AI scores and recommendations are not guaranteed to be accurate or free from bias.
• You are solely responsible for all final hiring decisions.
• Do not use AI outputs as the sole basis for rejecting candidates where prohibited by law.

9. Subscription and Billing

Some features of Hirely require a paid subscription. By subscribing:

• You authorize us to charge your payment method on a recurring basis.
• Subscriptions auto-renew unless cancelled before the renewal date.
• Refunds are not provided for partial billing periods unless required by law.
• We reserve the right to change pricing with 30 days' notice.

10. Termination

You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate your account without notice if you violate these Terms or engage in conduct harmful to other users or the platform.

Upon termination, your access to the Service will cease and we will handle your data in accordance with our Privacy Policy.

11. Limitation of Liability

To the maximum extent permitted by law, Hirely shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising out of your use of the Service.

Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on the platform. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration or the courts of the applicable jurisdiction.
